I never did much care for texting. I'm a firm believer that phones should only send and receive calls - no more, no less; though I am drifting off-subject here.

I'm not sure what to think of suing Shannon for texting a person that was driving. There's no real way to know if he did or didn't actually know the person was driving, or if he cared. I've got different opinions varying based on the answers to those two questions.

The reality is, you could be held responsible for aiding the injury/death of other individuals, even if you werent there. Texting while driving is a prime example of this. When you are distracted while driving, the chance of injury/death in vehicular accidents increases that much. Awareness of the other driver also plays a major factor in this. Should she have been aware on what's going on and/or if she asked if the receipient of the text whom she was texting to and the recipient replied back to her about what he is doing, she then will be held liable should she continues to text. But if she wasn't aware that Best was driving, she wouldn't be held liable. Encouragement in this case means continually texting to someone and the recipient is tempted to text back and does it, at the expense of something. In the past, the person who send the text is consoled that he/she didn't seriously injure or kill a person because of the text, let alone be burdened with immense guilt. But this case can prompt retroactive lawsuits if my predictions are correct.

Strange case. Sounds pretty dubious from a legal standpoint, but who knows.

On the other hand, texting while driving is a supremely stupid act, and I have trouble understanding why people feel as if they must be plugged in every second of every day, even while operating motor vehicles. I went to a high school baseball game last night, and this public service bulletin at the school sums it up pretty well: "Don't drive while distracted. It might be the last status update you ever make!"

It is here, too. (At least in North Carolina.) Sadly being illegal does little to nothing to solve the problem in many places.
